You'll have to tell the rental agency you'll be a driver. Most will charge you extra for an under 21 driver.

That would be an issue that you'd have to take up with the rental agency. As RedCSX recommended, inform the rental company of your status as a second driver and see what they say from there.

Just called the ins.co.... they still haven't received a statement from the other driver but proceeded with "not at fault" on my side and "100% at fault" for the other driver. The pictures I've sent them must've really helped!! thanks for everyone who commented on this thread! now I can go and get the car fixed
