Re: Ridiculous Ontario Police Harassment Story!!!!MY Story
and with this thread.. my whole thing is that the police EXTEND their authority a little too much.
if anyone of us breaks a traffic violation, it is our right. give us the ticket and let us be.
there is no need to be a ******** about things.

Re: Ridiculous Ontario Police Harassment Story!!!!MY Story
I definitely signed it!
And about the 50 over - if it's not a witch hunt - it's true, why would they make you pay a week's worth of impound fees and towing fees??? If it was all about safety and it has nothing to do with the government's greed - why would you be doing that?
And wait until those passenger laws get passed (limiting the amount of passengers you can have in your car, regardless of the amount of seatbelts)...remember when Canada was a "free country"? lol

haha...you got warrants!
I think you'll get arrested, and then fingered in jail. Actually I think you would have heard about this ticket by now. 8 years ago? wow.

8 years ago, you're fine.
I'm 25 years old, I think I'm smart (I got a house and a S4, can't be that dumb, lol) and I say don't worry about it

Driving is not a right nor a freedom... the vehicle and licence seizure is to prevent continuation of offence which is an integral part of our legal system. The term "witch hunt" implies people are being charged for things they aren't doing which is not the case. Making up the "contempt of cop" scenario is ridiculous. All these complainers fully admit to breaking the law... they just don't like the consequences.... On your logic we shouldn't hold serial killers in jail before they have their day in court because they might not be guilty or maybe an angry cop framed them because they were rude.
As for the quote from Stats can it was for the person complaining about why new drivers get hammered with strict rules... not the prior convo.
edit: FYI impound fees go to the autowrecker's pound not the government, so they don't make a buck off of that

Re: Ridiculous Ontario Police Harassment Story!!!!MY Story
jeff you're not helping your cause.
my reference to the charter of rights and freedoms had nothing to do with driving, but had everything to do with my right to a trial if accused of breaking a law. Whether its a HTA violation or a Criminal Code law...or a bylaw for parking illegally...I HAVE A RIGHT. With the new speeding law we don't.
Contempt of Cop is ridiculous? ask a police psychologist (I did).
I used the term witch hunt to refer to 'due process' being thrown out the window, not the charging of innocent people. It has to do with the police force's perfervid application of this law and it's penalties without the accused having a chance to have his (or her) day in court. Witch hunt refers to people being attacked/hunted by fear mongering religious freaks for the 'crime' of practicing witchcraft. READ THREAD.
As for the serial killer reference, clearly you haven't actually sat in on a trial from beginning to end, have you. Even serial killers (very rare by the way...horrible reference) ARE NOT immediately held without bail. They have a hearing to determine whether or not they will be granted bail. THEN they have a trial to determine if they are indeed guilty, beyong a reasonable doubt. They ARE NOT punished by the police force...and there's a damn good reason for that!
I don't think you're winning any friends with your views/comments, so I'm going to suggest we all let our armchair legal wrangling end here.

Re: Ridiculous Ontario Police Harassment Story!!!!MY Story
I'm not looking for friends I am trying to show you that driving is not your RIGHT therefore you can have your license seized or suspended at ANYTIME whether you have had a trial or not. When you want to drive you have to be a certain age and pass certain tests then the Government of Ontario grants you permission to drive, permission they can revoke whenever they want, ie, poor driving judged by police or MTO, not paying child support, not paying parking tickets, drinking and driving.
Again these laws are designed to temporarily prevent a continuation of the offence just like the 90 day administrative drivers licence suspension you get when you are charged, read: not proven guilty in court yet. Again, a point you failed to consider, prevention of continuation of offence which protects victims and society. You go to court to answer to your charge, you lose your licence and your car because you have been judged to be a irresponsible driver by sworn civil servants representing the province.
Your right to a trial is not violated, you get a trial to answer to the specific charge and there it is decided what your punishment will be for that charge.
I am not trying to get into a pissing match with anyone but I can assure you, and even encourage you to not make assumptions. I have been to criminal and trafic court HUNDREDS of times. I have testified in many types of trials and can assure you I KNOW my laws, I know why they are in place and I have a VERY in depth knowledge of our legal system. I appreciate your argument but you are flawed in your understanding of its purpose and its legality. I encourage you not to judge the system until you fully understand it. I would be more than happy to meet you at court, even traffic court and show you the reasons people come up with for getting caught doing things.... In the years I have worked in the legal profession, I have never heard an accused say that they were driving and an officer stopped them and made a charge up, NEVER. I am not saying this can't happen, but if it does it is extremely rare. There are more than enough bad drivers to charge. The risk to an $80,000 + a year job just to jam someone with a fictitious ticket would prevent that temptation.
As for the bail comment, all serious criminals are held immediately without bail, which is actually called a show-cause hearing. They can remain in police custody for days, then they are transferred in custody to a holding facility, then a bail court in cuffs and in a prisoners box. So at not time between the show-cause and when they were arrested are they free in society.
There are no specific "Police psychologists", they go to the same ones the rest of the public does. They don't hire staff psych's and I would challenge anyone against taking the opinion of one individual to paint the picture of a group of people (believe that would be prejudging based on the actions of a few).
